Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased from BIPZ and Bobs LLC shall be resolved exclusively through binding arbitration, rather than in court, except that either party may bring an individual action in small claims court for disputes within that court's jurisdiction. The arbitration shall be administered by an arbitration administer of our choosing under its applicable rules then in effect. The arbitration shall take place in Denver County, Colorado, or another mutually agreed location, and shall be conducted in English. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and BIPZ and Bobs LLC agree that any arbitration or proceeding shall be conducted on an individual basis only, and not as a class, collective, consolidated, or representative action. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator shall have no authority to combine or aggregate claims of more than one person, or to preside over any form of a class, collective, or representative proceeding. If this Class Action Waiver is found to be unenforceable as to a particular claim or dispute, that claim or dispute shall proceed in a court of competent jurisdiction, and the remainder of this arbitration agreement shall remain in force for all other claims.
